- The session will provide insight on the applicable laws and regulations that apply to physician compensation arrangements (i.e., the anti-kickback, Stark, and tax-exemption laws), including the fair market value and commercial reasonableness requirements. Time will be spent on potential changes that CMS could make to the Stark Law later this year.
- The speakers will touch on methods for auditing physician arrangements to include both
(i)procedural (e.g., review, execution, supplemental requests) and(ii)substantive considerations (e.g., necessity, fair market value, etc.). - They will also discuss important items to consider when issues are found, including strategies for documenting fair market value and for amending, resolving, and self-disclosing potentially non-compliant arrangements.
